Facts
D.R. Womack (plaintiff) was gifted a deed to mineral rights by his brother, W.B. Womack. The deed was delivered with the name of the grantee left blank. W.B. told D.R. that he was authorized to name anyone he wanted as the grantee. W.B. Womack later died and was followed in death by his wife, Louise. Stegner (defendant) was the heir to Louise Womack’s property by will. D.R. Womack filed suit to quiet title to the interest in mineral rights created by the deed from W.B. Womack. The trial court granted Stegner’s motion for a directed verdict after the close of Womack’s case in chief. Womack appealed.
