Facts
Patrick Wood (defendant), a Colorado state prisoner, filed a petition for a writ of habeas corpus in federal district court. The state of Colorado (plaintiff) did not challenge the timeliness of the petition. The district court denied the petition on its merits, and Wood appealed. On appeal, the court of appeals raised the issue of the petition’s timeliness sua sponte and affirmed the district court’s denial because the petition was untimely.
