Facts
After a shipping collision involving international vessels in international waters, World Tanker Carriers Corp. (World) (plaintiff) sued M/V Ya Mawlaya (defendant), one of the ships involved, in United States district court. The district court dismissed World’s claim, finding that it did not have personal jurisdiction over the Ya Mawlaya. World appealed, arguing that Federal Rule of Civil Procedure 4(k)(2) applied to admiralty cases and that the court had in personam jurisdiction over the Ya Mawlaya under that rule.
