Facts
Shortly before the September 11 terrorist attacks, World Trade Center Properties, L.L.C. (plaintiff) changed ownership, and its new owners purchased insurance coverage from Travelers Indemnity Company (defendant). Travelers issued the owners a binder on July 19, 2001, the date that the insurance coverage was purchased and went into effect. Travelers did not issue the final policy until September 14, 2001. The World Trade Center owners made claims against the policy to recover some of the loss that was incurred from the attacks. The owners urged that the terms of the policy that issued on September 14 governed the coverage of the properties’ September 11 losses. Travelers disagreed, arguing that the binder’s terms controlled.
