Writ of Trespass on the Case in Trover
From Henry J. Stephen, Pleading 18
London, J. Butterworth 1824
Facts
AB owned 20 valuable tables and 20 valuable chairs. CD somehow came to possess AB’s tables and chairs. AB asked CD to return the tables and chairs on multiple occasions. CD knew these items belonged to AB but refused to return them. AB brought an action in trover against CD, alleging that (1) AB had lost the tables and chairs, (2) CD had found the items, (3) CD had converted the items to his own usage instead of returning them, and (4) CD owed damages to AB for converting AB’s property into his own.
