Facts
Wronski (plaintiff) filed suit for damages on claims that Sun Oil (defendant) had illegally extracted oil in violation of limits imposed under a proration order issued by the Michigan Department of Natural Resources. Wronski claimed that Sun Oil exceeded its legal production limits by 180,000 barrels. The trial court concluded that Sun Oil had exceeded its production limits by 150,000 barrels, of which 50,000 barrels had been illegally withdrawn from beneath Wronski’s property. Sun Oil appealed.
