Facts
Wyeth (plaintiff) sued Boston Scientific Corp. (BSC) and Abbott Laboratories (defendants) for patent infringement. BSC hired the law firm Howrey LLP to represent it in the lawsuit. Wyeth moved to disqualify Howrey because the firm already represented a Wyeth entity in European patent litigation. The magistrate judge granted the motion to disqualify the firm, but the district court judge reconsidered.
