Facts
On June 30, 2001, Faranak Yaghoubinejad (plaintiff) and Babak Haghighi (defendant) participated in a marriage ceremony with two witnesses. The marriage certificate noted the ceremony was performed according to Islamic tradition; the certificate was also signed by the person who solemnized the marriage. Yaghoubinejad and Haghighi never obtained a marriage license. On July 15, 2005, Yaghoubinejad filed a complaint for divorce, alleging she and Haghighi had been separated for more than 18 months. Haghighi filed an order to show cause requiring Yaghoubinejad to provide evidence of a legal marriage and seeking an order requiring Yaghoubinejad to withdraw her complaint. The trial court judge denied the order to show cause, finding that the validating acts cured any defect in the ceremony. The trial court declared Yaghoubinejad and Haghighi were validly married. Haghighi appealed.
