Facts
Andrew Yates (plaintiff) was involved in an accident with a truck that was driven by an employee of Bair Transport, Inc. (Bair) (defendant). The police report included written statements that contained specific details about the accident. The police report did not identify the individual who made these statements. But it was possible that the statements were made by a civilian bystander who personally observed the accident. Yates brought suit against Bair. At the district court, Yates introduced the statements in the police report. The out-of-court statements were offered to prove the truth of what was written in the statements. The parties requested that the district court rule on the admissibility of the statements.
