Facts
Donnelly (plaintiff) sued Yellow Freight System (Yellow Freight) (defendant) in state court, alleging sex discrimination in violation of Title VII of the Civil Rights Act of 1964. Yellow Freight removed the lawsuit to federal court. After the lawsuit was filed in state court but before it was removed to federal court, the statute of limitations expired. Yellow Freight moved to dismiss the lawsuit as untimely filed, arguing that the federal courts have exclusive jurisdiction over Title VII lawsuits and thus that the state filing date did not meet the requirements of the statute of limitations. The district court denied the motion, and the court of appeals affirmed. The United States Supreme Court granted certiorari.
