Facts
Mary Zelenko died after falling ill in a Gimbel Brothers, Inc. (defendant) department store. The administrator of her estate, Jacob Zelenko (plaintiff), said the store put Mary in its infirmary and left her there alone for six hours without medical care. Jacob sued the store on Mary’s behalf. Gimbel argued that it had no duty to provide Mary medical care.
