Zhang Chengzhi (plaintiff), a writer, sued the operator of a website, 21 ViaNet Communication Technology Company, Ltd. (ViaNet) (defendant), for the unauthorized publication of two of Zhang’s works. The trial court held that the publication constituted copyright infringement and ordered ViaNet to cease the publication, pay damages, and make a public apology to Zhang. ViaNet appealed to the Haidan Intermediate People’s Court.
