Rule 1.10 of the Model Rules of Professional Conduct

Rule 1.10 of the Model Rules of Professional Conduct

Definition

Rule governing the imputation of a disqualified lawyer’s conflict of interest to other lawyers in the firm. The rule provides that lawyers associated in a firm may not represent a client when a conflict of interest would prohibit any one of the firm’s lawyers practicing alone from representing the client unless the prohibition is based on (a) a personal interest of the disqualified lawyer that would not materially limit representation by other lawyers in the firm or (b) the representation of a former client while the disqualified lawyer was associated with another firm, and the disqualified lawyer is screened from participating in and obtaining a fee from the matter.
