Facts
The Pennsylvania Liquor Control Board (the board) (defendant) promulgated regulations prohibiting beer manufacturers from raising prices for distributors within 180 days of reducing prices or introducing new branding or packaging. The regulations also required that if manufacturers reduced their price for one distributor, they must reduce their price for all distributors in the state. Anheuser Busch, Inc. (plaintiff) sued the board, alleging that the regulations violated the Sherman Act by impeding competition. Anheuser Busch moved for summary judgment.
