Facts
Fagnelli Plumbing Company (plaintiff) and Gillece Plumbing and Heating, Inc. (defendant) competed in the plumbing, heating, and cooling business. Fagnelli was in the business and advertised its company for more than 50 years. Beginning in 2000, Fagnelli used the domain name fagnelliplumbing.com. In 2007, Gillece purchased the domain name fagnelli.com. When users visited fagnelli.com, they were redirected to Gillece’s website. Gillece also registered almost 100 other domain names with names similar to competing plumbing companies. Fagnelli sued Gillece under the Anti-Cybersquatting Consumer Protection Act (ACPA) and moved for summary judgment.
