Facts

Societe Gotaverken Arendal A.B. (Gotaverken) (plaintiff) obtained an arbitral award against General National Maritime Transport Co. (GNMT) (defendant) following arbitration proceedings in France conducted under the rules of the International Chamber of Commerce (ICC). In their arbitration agreement, the parties had agreed to comply with the arbitral award as finally binding and enforceable. Nonetheless, GNMT instituted an action in French court seeking to set aside the arbitral award. While the French case was pending, Gotaverken filed an action in Sweden, seeking to enforce the arbitral award. The Sweden Court of Appeal ordered enforcement of the arbitral award in Sweden. GNMT appealed to the Sweden Supreme Court, arguing that the decision of the court of appeals should be reversed on ground that the arbitral award was not yet final because the French court proceedings had not yet concluded.
