Facts
In November 2002, Jesús Tranquilino Vélez Loor (plaintiff) was arrested in Panama and prosecuted for crimes related to his irregular immigration status. From Vélez Loor’s arrest in November 2002 until his deportation in September 2003, Vélez Loor was held in several Panamanian prisons pursuant to Panama’s Article 67 of Decree Law 16 of 1960. Vélez Loor filed suit against the Republic of Panama (Panama) (defendant) in the Inter-American Court of Human Rights, arguing that his arrest and detention, without meaningful access to due process, violated multiple terms of the American Convention on Human Rights (the convention), including Article 7(3), which protects an individual’s right to liberty.
