Facts
Larry Kasey (defendant) shared whiskey and oxycodone pain pills prescribed for his back pain with coworkers at a restaurant employee party. Coworker Nathan Followill died later that night from a lethal combination of alcohol and oxycodone after Kasey gave Followill’s girlfriend eight oxycodone pills. Followill’s mother, Susan Gipson (plaintiff), brought a negligence action against Kasey for wrongful death. The trial court granted summary judgment for Kasey, finding that Kasey owed Followill no duty of care. The appellate court reversed, prompting Kasey to appeal to the Arizona Supreme Court.
