Facts
Jayshawn B. (defendant) was arrested for shoplifting from an American Apparel store. Jude Bright, a store asset-protection investigator, watched Jayshawn B. take the items on a live feed, but the videotape of the incident was destroyed. Jayshawn B. argued that Bright should not be allowed to testify, because of the best-evidence rule.
