In re Northwest Airlines Corporation
United States Bankruptcy Court for the Southern District of New York
363 B.R. 701 (2007)
- Written by Ryan Hill, JD
Facts
Northwest Airlines Corporation (Northwest) (debtor) filed for reorganization under chapter 11 of the bankruptcy code. An ad hoc committee of equity security holders (equity committee) (creditor) filed a disclosure statement as required under the Federal Rule of Bankruptcy Procedure Rule 2019. Northwest alleged that the statement failed to meet the requirements of Rule 2019 because the statement did not identify the members of the committee and only listed the claims of the committee members in aggregate, rather than individually. Northwest filed a motion to require the committee to revise its disclosure statement.
