Facts
The defendant, a thirteen-year-old male, was charged with sexual assault of a nineteen-year-old girl (victim). The victim introduced expert testimony that she was mentally retarded and thus could not fully comprehend the sexual acts in which she engaged. The defendant sought to introduce evidence that the victim was in a relationship with a forty-year-old man and evidence that the victim had been taking birth control. The trial court ruled all of this evidence inadmissible under Hawaii’s rape shield law. The defendant was convicted. He appealed.
