Indonesia Supreme Court
XI Y.B. Comm. Arb. 508 (1986)
- Written by Mary Katherine Cunningham, JD
Facts
Navigation Maritime Bulgare (NMB) (plaintiff), a Bulgarian corporation, entered a contract with P.T. Nizwar (Nizwar) (defendant), an Indonesian entity. The contract contained an arbitration agreement. A dispute arose between the parties, and the parties referred the matter to arbitration. The arbitral tribunal consisted of a single arbitrator, and the tribunal was seated in London. The arbitrator entered an award for NMB for a certain amount with interest. When Nizwar refused to pay the arbitration award, NMB filed a suit in the Central Jakarta District Court to enforce the award. The Central Jakarta District Court ordered Nizwar to pay the amount identified in the arbitration award. Nizwar appealed to the Indonesian Supreme Court.
