Facts
Jordan Matthews (defendant) and Carol Matthews (plaintiff) were married. They experienced months of extreme marital stress consisting of separation, reconciliation, and further separation. During this period, Jordan alleged that Carol was on drugs and stole assets from his company safe. Carol alleged that Jordan took their son, refused to let her speak to their son, and threatened to initiate custody litigation if she did not sign a partition agreement. Carol signed the agreement, which partitioned title to most of the community-property assets to Jordan in exchange for relieving Carol from any debts relating to those assets. Carol received no assets in the partition. Carol filed for divorce and a distribution of community-property assets. The trial court granted the divorce and found that the partition agreement was void because it was procured through duress. Jordan appealed.
