Facts
Pam Davis (plaintiff) and Eddie Merrill (defendant) were a married couple who filed for divorce. Months after the divorce was completed, they began cohabiting. After cohabiting for some years, Davis and Merrill remarried, but they eventually divorced again. While Davis and Merrill were cohabiting without being married, Merrill purchased stock in a tractor company. Davis argued that she and Merrill formed an implied contract to treat the stock as community property. The trial court held that Davis was not entitled to a community-property interest in the stock. Davis appealed to the New Mexico Supreme Court.
