People v. Carroll
New York Court of Appeals
715 N.E.2d 500 (1999)
- Written by Rose VanHofwegen, JD
Facts
Three-year-old Shanaya Jones’s father beat her to death over the course of a 10-day visit with him and her stepmother, Lisa Carroll (defendant). Carroll did not call the police or seek medical assistance until Shanaya died. Carroll told police that she was Shanaya’s primary caretaker and acted as her mother during her visits with her father. A grand jury indicted Carroll for child endangerment on the ground that she was legally charged with Shanaya’s care. Carroll challenged the indictment on the ground that she was not the functional equivalent of Shanaya’s parent. The trial court agreed and dismissed the indictment, but the appellate court reversed and reinstated it. Carroll appealed.
