Ronny M. v. Nanette H.
Alaska Supreme Court
303 P.3d 392 (2013)
- Written by Mary Katherine Cunningham, JD
Facts
Ronny M. (defendant) and Nanette H. (plaintiff) dated between 1998 and 2002 without marrying. The couple had two children born in Florida in October 1999 and November 2000. Ronny was abusive towards Nanette throughout the relationship, and in June 2002, Ronny was arrested for assaulting Nanette. A family court in Florida granted Nanette a temporary order of protection, granting Nanette custody of the children. Ronny was subsequently arrested and convicted of assaulting Nanette on two more occasions in 2002. In September 2002, the Florida Department of Children and Families asked the court for an emergency-shelter hearing. The court granted Nanette custody of the children and awarded Ronny supervised visitation. Ronny remained involved in the children’s lives until April 2007. Nanette moved the children to Alaska and filed a complaint seeking primary physical and sole legal custody in November 2010. Ronny filed an answer from Florida, asserting Nanette had made it impossible for him to communicate with his children and seeking primary physical and sole legal custody. The trial court in Alaska granted primary physical custody to Nanette and joint legal custody. Ronny appealed.
