Facts
James Oimen (defendant) helped plan a robbery of Tom Stoker with Shawn McGinnis. Oimen provided information about the layout of Stoker’s home and the sums of money that Stoker kept in his home. During the robbery, Oimen waited in a getaway car while McGinnis went into the home. Stoker shot and killed McGinnis. The State of Wisconsin (plaintiff) charged Oimen with felony murder. The jury convicted Oimen, and he appealed.
