Facts
Eileen Theisen (plaintiff) brought an action in family court for separate maintenance and support from her husband, Clifford Theisen (defendant). Eileen and Clifford were still living in the same home, albeit sleeping in separate rooms, at the time of the action. The family court dismissed Eileen’s complaint. The court also canceled Eileen’s lis pendens and request for attorney fees. Eileen appealed. The South Carolina Supreme Court granted certiorari.
