Facts
Michael Velez (plaintiff), a commercial-truck driver, purchased TND 730 and TND 740 GPS devices (the TND devices), which were manufactured by Rand McNally (Rand) (defendant). The TND devices included features like truck-specific routing and detailed information on truck stops. Velez experienced repeated problems with the TND devices, and Rand was unable to repair the devices. Subsequently, Velez filed suit against Rand under the Magnuson-Moss Warranty Act (MMWA), which established certain minimum warranty standards under federal law. Rand filed a motion to dismiss, which the district court took under advisement.
