Facts
Thomas Vetor (defendant) sold a house to Judy and Richard Shockey (plaintiffs). Vetor had lived in the house for four years and warranted that the property contained a working septic system. The septic system in fact was in need of repair at an estimated cost of approximately $1,000. The Shockeys sued Vetor for breach of an implied warranty of habitability in the sale. The trial court ruled in favor of the Shockeys. Vetor appealed.
