Facts
Mrs. Wand (plaintiff) and Mr. Wand (defendant) were the parents of a child who was around six years old. Mrs. Wand filed for divorce because Mr. Wand attempted to murder her. There was no evidence to support Mr. Wand’s claim that the attempt was justified because Mrs. Wand was unfaithful, and the court found that Mr. Wand was a peaceful man aside from having attempted to shoot his wife in the chest. The trial court granted the divorce to Mrs. Wand on the basis of Mr. Wand’s extreme cruelty and granted custody of the child to Mr. Wand. Mrs. Wand appealed the grant of custody to Mr. Wand.
