Facts
Morehead City Sea Food Co. (defendant) acquired fish that it then left in the sun for 36 hours before preparing and packing, causing the fish to go bad. Morehead sold the fish to a grocer. A customer of the grocer purchased the fish, became sick after eating it, and died. The decedent’s estate (plaintiff) brought suit. The evidence showed that several people in the area became sick after eating the fish and that Morehead was aware of this but took no action in response. The jury found in favor of the decedent’s estate. Morehead appealed. The North Carolina Supreme Court granted certiorari.
