Facts
MTM Productions (MTM) (defendant) entered into a series of signed written agreements with Triplet Music Enterprises, Inc., for the services of Richard Warren (plaintiff) to compose an original musical score for the television series Remington Steele in exchange for a fixed-compensation fee upon completion and royalties. Warren sued MTM and the producers and broadcasters of the series (defendants) for copyright infringement, among other claims, when Warren failed to receive certain royalties to which he was entitled under the agreements. The district court granted MTM’s motion to dismiss, holding Warren lacked standing because the compositions (works) were made-for-hire. Warren appealed.
