Facts
Charmaine West operated a probation services company, First Alternative Probation Counseling Services, Inc. (plaintiffs), that took referrals from the courts. A television station aired a story claiming that the business was illegal, implying that West and one of the judges had a “cozy” improper relationship. West brought a federal lawsuit against the station operator, Media General Convergence, Inc. (defendant), for defamation and false-light invasion of privacy. On certification, the federal court asked the Tennessee Supreme Court whether state law recognized the tort, and if so, what were its elements and parameters.
