Facts
James White (plaintiff) and Barbara White (defendant) were married, and James filed for divorce after 23 years of marriage. James filed an affidavit, claiming total marital assets of $8.5 million and annual income of $185,000. Barbara informed the court that she was unemployed and had been diagnosed with an inoperable brain tumor. Barbara listed the marital assets at $20 million, but stated she had no access to the couple’s financial documents. During the trial, James admitted he did not reveal to the court or Barbara that he deposited $1 million from the sale of the couple’s businesses and that he had at least two other bank accounts. The trial court entered an order granting each party an equal share of the marital assets. The trial court did order James to pay Barbara’s attorney’s fees due to his misconduct during the proceedings, but the court did not order James to pay Barbara alimony. James appealed the trial court’s final dissolution order, and Barbara cross-appealed, alleging the trial court erred in its award of marital assets. James and Barbara both filed appeals.
