Facts
Patricia White (plaintiff) filed for divorce from John White (defendant). The state divorce court ordered John to make temporary alimony payments of $800 per week. John did not comply with the order. Patricia moved for the appointment of a receiver for John’s property. John then initiated proceedings in bankruptcy court under Chapter 11 of the Bankruptcy Code. This triggered an automatic stay, halting the divorce proceedings in state court. Patricia moved to lift the stay, which the bankruptcy court did. John appealed the lifting of the stay to federal district court, which upheld the bankruptcy court’s decision. John again appealed. The United States Court of Appeals for the Sixth Circuit granted certiorari.
