Facts
An airplane owned by Southeast Skyways, Inc. (Southeast) (defendant) crashed into the ocean near an Alaskan island. The pilot and his three passengers died in the crash. Carmelita Widmyer and A. Dermott O’Toole (plaintiffs) sued Southeast on behalf of the deceased passengers’ estates. At trial, the plaintiffs requested that the jury be instructed that airlines owe a duty of utmost care and vigilance toward their passengers. The trial court denied this request. The jury found in favor of Southeast. The plaintiffs appealed.
