Facts
Georg Wierzchula (defendant) entered into an earnest-money contract to purchase a home before he was married. He applied for a home-loan guaranty with the Veterans Administration as a single man and was issued a certificate of loan commitment as a single man. One month later, Georg married Margarita Wierzchula (plaintiff). Two months later, Georg received the deed conveying the property to him as a single man. George executed the deed of trust and a promissory note in his individual capacity. When the parties divorced, the trial court awarded the property to Georg as his separate property. Margarita appealed.
