Facts
Tory Williams (plaintiff), the parent of minor K.W.B., purchased a temporary-henna-tattoo kit from Amazon.com, Inc. (Amazon) (defendant). K.W.B. used the kit to create a temporary henna tattoo but suffered scarring and burning. Subsequently, Williams brought suit against Amazon, contending that it breached the implied warranty of fitness for a particular purpose. Amazon filed a motion to dismiss, which the district court took under advisement.
