Facts
Williams (plaintiff) was shopping for a used car with air conditioning. A salesman at Rank & Son Buick, Inc. (Rank) (defendant) showed Williams a car and told him it was air conditioned. Williams inspected the car and took it for an hour and a half test drive. Williams, an educated man who owned his own business, bought the car but subsequently discovered that the car did not have air conditioning. He brought suit against Rank, claiming fraud. The trial court ruled in favor of Williams. Rank appealed.
