Facts
Linda Williams (defendant) and Louis Williams (plaintiff) were married. On the day before the wedding, Louis drove Linda to a bank parking lot and presented her with a premarital agreement to sign. Louis stated that the agreement was to help secure his separate property in order to protect his children from a prior marriage. The agreement identified Linda’s and Louis’s separate properties, and it stated that incomes from these properties would remain separate properties during the marriage. Linda said that she did not want to sign the agreement. However, she signed it because 20 guests were scheduled to attend the wedding the next day. Linda was very educated, had substantial experience in business and with contracts, and worked for a bank. After the parties separated, Louis tried to enforce the premarital agreement. The trial court held that the agreement was valid. Linda appealed, arguing she was coerced into signing it.
