Facts
John Wilson (plaintiff) and Shirley Wilson (defendant) married in March 1968, separated in 1990, and began divorce proceedings in October 1998. In February 2000, the trial court entered a decree of divorce. In the decree, the trial court awarded 50 percent of the community property to Shirley, including the value of retirement accounts relating to John’s employment. The trial court used February 2000 as the valuation date, resulting in a smaller award to John than he would have received had the trial court used 1990 as the valuation date, because the retirement accounts’ value appreciated after the separation. John appealed, arguing, among other things, that the trial court should have used 1990 as the valuation date.
