Facts
Windram Manufacturing Company (Windram) (plaintiff) was in the business of pasting linings to fabrics using a paste purchased from Ellis. Boston Blacking Company (BB) (defendant) manufactured the paste for Ellis and knew it would be used by Windram. Windram brought an action alleging that BB’s careless and negligent mixing of the paste injured the fabrics on which the paste was used and that Windram lost money as a result. Windram also alleged that BB mixed the paste in a way that made it deleterious and dangerous and certain to injure fabrics and linings and that BB knew the paste was made for Windram’s sole use and that carelessness in manufacturing the paste would injure Windram’s fabrics. BB’s demurrer was sustained, and judgment was entered for BB. Windram appealed.
