Facts
Myrle Wuebker (defendant) and Peggy Wuebker (plaintiff) married in 1973. Myrle made important decisions, such as buying a car, without talking to Peggy about it. Peggy and Myrle each had full-time jobs, but Myrle did not help Peggy with the chores. Peggy and Myrle often went for weeks without speaking to each other. Peggy became unhappy in the marriage and filed for divorce in July 2002, alleging that she and Myrle were incompatible and that Myrle was guilty of gross neglect of duty and extreme cruelty. Myrle denied Peggy’s allegations because he thought that there were no problems in the marriage. The trial court could not grant a divorce on the grounds of incompatibility unless both Myrle and Peggy agreed, so the court granted the divorce on the grounds of Merle’s extreme cruelty. Myrle appealed.
