Facts
Gary Young (defendant) married Pamela Young (plaintiff). Before the marriage, Gary formed Dax Enterprises, Inc. (Dax). During the marriage, Gary was Dax’s sole employee and was solely responsible for Dax’s financial management. Although Gary put substantial time and effort into Dax, Gary paid himself a small income and placed this income into Dax’s corporate accounts. Gary used the commingled funds to pay his separate debts, including day-care expenses for a daughter from a former marriage. Gary placed community assets, including the Youngs’ home, in Dax’s name. A substantial amount of Dax’s money was unaccounted for. Pamela filed for divorce. The trial court found that Dax was Gary’s alter ego. The trial court therefore awarded Pamela a money judgment and an equitable lien in community assets to secure Pamela’s money judgment. Gary appealed.
