Facts
Cream Records Inc. (plaintiff) brought suit against Joseph Schlitz Brewing Co. (defendant), alleging that music in a television commercial prepared by Benton and Bowles to market Schlitz beer infringed Cream’s musical composition, “The Theme from Shaft.” The district court found infringement and awarded Cream a total of $17,000 in damages. Cream appealed.
