Facts
Cindy Horak (plaintiff) sued Building Services Industrial Sales Company (BSIS) (defendant) as special administrator of the estate of her father, George Benzinger. The suit alleged that BSIS exposed Benzinger to asbestos, causing his death. Horak sought to introduce invoices showing that BSIS sold products containing asbestos to Benzinger’s employer. The invoices were over 20 years old and came from the office of BSIS’s former attorney. The circuit court excluded the invoices as hearsay. Horak appealed.
