Facts
McCue (defendant) owned land that is located on the slope of a hill. At the bottom of the hill was a pond on land owned by Middlesex Co. (plaintiff). McCue planted a garden on his land, which caused soil from his land to slide down the hill and into Middlesex’s pond. Middlesex filed a lawsuit against McCue to stop the filling of its pond.
