Facts

Stacey Miller and others (plaintiffs) sued Dillard’s, Inc. (defendant) for an incident in which they were detained by an individual purporting to be a Dillard’s security guard. Miller sought to introduce evidence that the security guard displayed a badge. Dillard’s contended that the act of displaying a badge constituted inadmissible hearsay. Dillard’s moved for summary judgment.
