Facts
Triangle Insulation and Sheet Metal Company (Triangle) (defendant) contracted to advise Southern Illinois Riverboat Casino Cruises, Inc., doing business as Players Island Casino (Players) (plaintiff), on installing a new ventilation system on Players’ casino riverboat. On Triangle’s recommendation, Players sealed the system with a third-party manufacturer’s sealant. The sealant package limited the manufacturer’s liability to refunding a disappointed buyer’s purchase price. After sealant fumes sickened the riverboat passengers and forced Players to close the casino for expensive repairs, Players sued Triangle for breach of warranty. Triangle asserted the sealant manufacturer’s remedy limitation in defense. The federal district court, applying Illinois law, granted Triangle’s motion for summary judgment. Players appealed to the Seventh Circuit.
